Acceptance of Terms

By accessing or using FairFate (“we,” “our,” or “us”), located at fairfate.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

Description of Service

FairFate is a digital marketplace for tabletop RPG products. We provide a platform for creators (“Sellers”) to list and sell digital and physical goods, and for customers (“Buyers”) to discover and purchase these goods.

User Accounts

Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Age Requirements

You must be at least 13 years old (or 16 years old in the EU) to use the Service. If you are under 18, you represent that you have your parent or guardian’s permission to use the Service.

Marketplace Terms

For Buyers

  • Purchases: When you buy a product, you acquire a license to use that product in accordance with the terms set by the Seller.
  • Refunds: Please refer to our Refund Policy for information on refunds.

For Sellers

  • Listings: You are responsible for the accuracy and content of your listings.
  • Delivery: You agree to deliver digital goods immediately upon purchase and physical goods within the timeframe specified in your listing.
  • Taxes: You are responsible for determining and paying any applicable taxes resulting from your sales.

Content and Conduct

Prohibited Content

You may not post, upload, or transmit any content that:

  • Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, or tortious.
  • Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.
  • Infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party.
  • Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment.

User Conduct

You agree not to:

  • Use the Service for any illegal purpose.
  • Attempt to gain unauthorized access to the Service or its related systems or networks.
  • Interfere with or disrupt the integrity or performance of the Service.

Intellectual Property

Our Content

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of FairFate and its licensors. The Service is protected by copyright, trademark, and other laws.

User Content

You retain all of your ownership rights in your Content. By uploading Content to FairFate, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for the purpose of operating and marketing the Service.

Payments and Fees

Payment Processing

We use third-party payment processors to bill you through a payment account linked to your account on the Service. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processor in addition to these Terms.

Fees

FairFate charges a platform fee on sales made through the marketplace. These fees are deducted from the transaction amount before payout to the Seller. Current fee structures are available in the Seller Dashboard.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account in your settings. Appeals may be made to martin@fairfate.com.

Disclaimers and Limitation of Liability

Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Limitation of Liability

In no event shall FairFate, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
